This might help you better understand the problem Josiah Rivers.

In response to a crisis of massive prison overcrowding, Gov. Schwarzenegger has called for the construction of two more prisons.

Since 1980, the State of California has built more than 20 prisons, and its prison population has increased about fivefold.

With about 170,000 inmates, it has a higher per-capita incarceration rate than the rest of the United States, which itself has the highest per-capita prison population in the industrialized world.

This is all good news for law enforcement unions and politicians. From the public's point of view, however, it is not so positive.

In a typical example of the failure of big government, we see that no matter how many prisons are built, no matter how much money the politicians throw at the problem, there is overcrowding.

Conditions for prisoners deteriorate. Rape and brutality have become the norm.

The most obvious reform is almost never mentioned: Stop locking up so many people and start letting a lot of people out.

Surely America isn't the most criminal culture on earth. Why does the United States have the most prisoners? The main reason is too many laws.

More prisoners are locked away for drug violations than all violent crimes combined. It used to be perfectly legal for anyone to walk into a store and buy heroin or cocaine. Then the progressives took over in the early 20th century and began waging a war on drugs, which blossomed under Franklin Roosevelt's New Deal, when marijuana became nationally illegal.

People have a right to liberty, property, and the pursuit of happiness. It is an affront to the founding principles of America to lock peaceful people into cages just because they consume or sell drugs.

It is also ineffective in reducing drug abuse. And it leads to more violent crime, gang warfare, judicial and police corruption, and all the other problems that accompanied alcohol prohibition.

Those who have committed no crime against person or property should be released from the jails and prisons. These include drug offenders, sex workers, those in possession of illegal guns, and anyone else who has hurt and threatened no one, whose only offense was to violate a victimless crime statute.

At a cost of about $35,000 per inmate per year, not only is keeping them in prison enormously expensive, draining resources that could be used to pursue actual violent criminals, but it is downright immoral.

As for minor property criminals, justice should be about making the victim whole, not about expensively caging people just to provide jobs for the prison guards, money for the bureaucracy, and talking points for tough-on-crime politicians.

Instead of being forced to pay taxes that go to jailing their offenders, victims should at least have the option of being reimbursed for what was stolen from them and compensated for their trouble.

Moving toward a restitution model would free up valuable space. So would stopping the overzealous enforcement of Three Strikes against people whose third strike was a minor, nonviolent offense.

Critics have accused Schwarzenegger of being too close to the prison guard lobby. Of course, Gray Davis wasn't exactly the lobby's enemy. Both Republicans and Democrats love the prison industrial complex.

It was Davis, in fact, who angered much of the left when he invited the corporations in to benefit from low-cost labor.

Whereas in a free market, businesses have to pay their employees an adequate wage or the employees can quit and go elsewhere, the corporate state provides a literally captive labor market for industry, socializing the costs to the taxpayers.

As with so much else that government does, it is horrible for the economy on balance, but some people get fabulously wealthy from it. Here we see a lot of the incentive for more prisons.

America and especially California have a sickness right now, an addiction to prisons that distinguishes them as the great incarcerators of the world.

This will not do in a free country. It is corrupting our culture and bankrupting our economy, all to benefit the corporate state that profits in proportion to how many of us are in cages.

Right now, California is taking the lead in prison abuse. Instead, it should take the lead toward sensibility and freedom, and start releasing those prisoners who have violated the rights of no one.

If the governor of California wants to build more prisons, good for him...at least he has the foresight to see what is needed! The only solution to prison overcrowding is for crimenals to stop offending...or apply a more "permament solution" to the problem. To say we should not lock up users and other lawbreakers because there are too many of them...is defeatism...surrender is not an option! More prisons and longer sentences would mean fewer crimenals to re-offend...and create much needed jobs for correctional officers...and construction workers...there is no downside!

Rikers Island, New York – Stabbings, beatings and brutal treatment from prison guards characterize this American prison. Filled primarily with offenders who are visible minorities, jailed on drug offenses, the prison is a hotbed of violence and aggression. In 2007, prisoner Charles Afflic was beaten senseless with a billy club by a prison official, who hit him repeatedly from behind: his injuries were so severe they necessitated brain surgery. 6 inmates committed suicide, hanging themselves with bedsheets in their cells, during the first six months of 2003 alone. Rikers has a reputation for its cruel treatment of mentally ill prisoners, who often turn to suicide in lieu of treatment and understanding.

at $35,000 per inmate...total savings to the state of New York...$210,000...minus a cardboard box and a hole in the ground...to be dug by prison labor...I fail to see the downside. Six fewer druggies to re-offend...six more beds opened up...they must be doing something right in New York.

Since you hide behind a fortified wall of children, what do you have to say for the children that you are leaving fatherless, and living in orphanages etc., because you wanted their parents who were non-violent offenders to wind up in jail?

...then the children...and society at large...are best served by removing them from such an unhealthy, and immoral enviroment. Children raised in these homes would grow into adults who themselves be at greater risk of commiting unlawful acts...and drug use. The kindest thing would to be to allow decent law abiding citizens to adopt these children...giving them a stable home life and consistent discipline in a loving enviroment. Those who choose to take drugs do not have the childrens welfare as there first priority...the drugs...and a selfish desire to get high...are the most important thing in a druggies life..all else is pushed aside.
 Once determined one is no longer fit to be a parent...due to drug use or incarceration...having there children removed from them...for the childrens own good...they should have to undergo a sterilization procedure as part of the terms of release from prison. Drug offenders and other dangerous crimenals are not what we want raising our future generations...the cycle must be broken!

I've been consumed in it for thepast few months. Also right now I'm helping on a movie set, some independent western that is taking place in the old mining town where I live. Criminal law is a lot of fun, and anthropology is really interesting. If you guys ever have questions concerning laws, most likely I'll have the answer :)  but according to Mr. Anti pot over here I'm not smart enough to get a college education and succeed in life, while raising my super intelligent 4 year old son, who by the way is reading and writing! I guess I should just give up now and get thrown in prison for smoking the ganja, maybe even the death penalty. Who the hell do you think you are? From an outsiders perspective I would say you think you are God himself or some kind of dictator. Do you think you should have the right to make life long decisions for these children? CPS is fucked. Children need their parents. But go ahead Josiah, try to  ruin lives, I'm sure that's what Jesus would want you to do!

From the look of your grammar I would say you graduated 6th grade! Congrats to you! No I don't swear around my son, that's wrong and I don't encourage him to be anythinig other than happy healthy and smart! I bet he knows more about the human anatomy than you do. They are both Christian, and they are the best parents that anyone could ask for. For your information, they both used to smoke, but don't anymore. They were accomplished even when they smoked. It doesn't break their hearts at all, they are very proud of me. It actually isn't addictive, but you wouldn't know about facts like that would you. Seriously there are drugs that hurt people, like meth! Marijuana is not harmful at all and has never killed anybody! What is it that you refuse to understand? You are just as bad as Linda...
